I am very sorry to hear that such a thing has happened to you and I can only imagine what you must have been through. bigdaddy in the above post has summed it up perfectly, it is better to let the insurance co. take care of this rather than doing an out of court kind of settlement. Indeed a learning for all the members of the forum

Lots of learning in this thread on how to handle such a situation. Main point is to keep a cool head and do whats logical even if on the onset it seems to be tedious and time consuming.

Does going to police or court give any relief to the vehicle owner? or its always the vehicle owner liable for such accidents?? for ex. pedestrians suddenly walking across the road etc.
In this case I do not see that the fact that pedestrian was drunken has made any difference ?
