This is a case wherein two points have been upheld in favour of insurance company by the National Consumer Disputes Redressal Commission.
-> The fact that knowledge that driver is drunk at the time of accident to the owner is immaterial, if the driver was driving with knowledge and consent of the owner.
-> Level of alcohol in blood is not a final determining factor to decide whether the driver was intoxicated or not and entire circumstances of accident have to be taken into account.
