JAIPUR: Rajasthan state consumer dispute redressal commission has ordered Mahindra & Mahindra, and its dealer Nagaur Automobiles to either replace the faulty Scorpio vehicle with a new one or reimburse the full cost of the vehicle to the owner accepting the argument of petitioner that there was some serious production flaws to the vehicle.
The commission has also directed to pay Rs 4 lakh for causing mental stress and economic loss to the buyer. It said that, half of Rs 4 lakh will be paid to the owner and remaining Rs 2 lakh to be deposited in the account of the state consumer welfare fund.
Kanaram said he purchased the vehicle on loan and had to pay monthly installments without any use of the vehicle. The dealer claimed that the vehicle has been repaired and the fault was due to misuse and negligence. Mahindra & Mahindra claimed that the vehicle has run about 44, 948 kms and it cannot be claimed that it was a production fault. However, the commission did not agree with the arguments of manufacturer as well as the dealer.
