FADA Once Again Knocks Honourable Supreme Court’s Door for BS-IV Sale Extension As Retail Sales Nosedive with Coronavirus (Covid-19) Epidemic​

The Federation of Automobile Dealers Associations (FADA) on behalf of its members has once again approached Hon’ble Supreme Court and has filed an Interlocutory Application along with an Application seeking modification in Writ Petition No. 13029 of 1985 in the matter of M. C. Mehta Vs Union Of India & others, dated 24th October 2018 whereby it has been directed that “…no motor vehicle conforming to emission standard Bharat Stage-IV shall be sold or registered in the entire country with effect from 01.04.2020.”

FADA President Ashish Harsharaj Kale said, ”Post our initial application, necessitated due to huge unsold BS-IV inventory and slowing sales, getting rejected by the Hon’ble apex court on 14th February’20, there has been a drastic change in circumstances in conducting business as usual. SARS-CoV-2 a.k.a Coronavirus (Covid-19) which emerged in Wuhan in the Hubei province of China has spread rapidly across the globe and also in India.

Following this in the past week there has been drastic drop in sales and customer walk-ins have reduced to a trickle as caution sets in due to fear of spreading of the Virus. Counter sales has fallen by 60-70% across auto dealerships in these past few days.

The situation has worsened in the past 3-4 days with partial lockdown situation in many towns and cities and few district magistrates have started issuing notices of closure of shops and establishments including auto dealerships to stop the spread of virus.”

Mr Kale went on to say, “Owning to situations which are beyond our control and the fact that many of our members may face dealership closures if leftover with unsold BS-IV stocks, FADA has once again approached the apex body with a request for permission of sale and registration of BS-IV vehicles till 31st May’20 and hopes to get an urgent hearing in the Hon’ble Supreme Court owing to the criticality of the issue and the deadline of 31st March approaching fast.”

Supreme Court refuses to hear plea on deadline relief for BS-IV sale​

NEW DELHI: In a setback to automobile dealers, the Supreme Court on Wednesday refused to hear their plea seeking permission to sell BS-IV vehicles beyond the March 31 deadline when BS-VI norms will kick in, to clear their inventory which they have not been able to sell due to economic slowdown and coronavirus scare.

A bench of Justices Arun Mishra and M R Shah refused to list the application filed by Federation of Automobile Dealers’ Associations (FADA) and said it can’t be heard before March 31.

As long as its only selling off the old manufactured BS4 stock billed to dealers, I guess it should be allowed since company has already sold the stock to dealers however, no new BS4 cars should be manufactured by any OEM post 31st March 2020 or sold by OEM to dealer..

question is, are some OEM hiding behind dealers to push BS4 inventory, out of the company?

Dealers Seek Relief On BS4 Stocks; Supreme Court Agrees To Hear Petition

We'd told you about the Federation of Automobile Dealers Associations (FADA) approaching the Supreme Court seeking an extension in clearing out the BS4 inventory. The body filed an interlocutory application in the Supreme Court along with an application seeking modification in Petition No. 13029 of 1985, directing that no motor vehicle with BS4 emission standard shall be retailed or registered across India from April 1 onwards. FADA has approached the apex body with a request for permission of sale and registration of BS4 vehicles till May 31, 2020, from the initial deadline of March 31, 2020.

New Delhi: The Supreme Court on Friday permitted the auto dealers to sell 10 percent of their unsold BS-IV inventory in the country, for 10 days post the 21-day lockdown period ending April 14.

However, a bench of Justices Arun Mishra and Deepak Gupta, who heard the matter through video-conferencing, made an exception by clearing that no BS-IV vehicles will be allowed to be sold in Delhi-NCR from April 1, 2020.

BS4 vehicle registration deadline likely to be extended

In his address to the nation earlier today, Prime Minister Narendra Modi announced an extension of the nationwide lockdown till May 3, 2020. The lockdown was originally supposed to span 21 days, from March 25 to April 15.

With the lockdown now extended, the Federation of Automobile Dealers Association (FADA) will be approaching the Supreme Court to review the BS4 vehicles registration deadline. To recap, on March 27, 2020, the Supreme Court had ruled that BS4 emission standard vehicles that were sold before the March 31, 2020, sales deadline but could not be registered by the date owing to the prevailing lockdown, can be registered until April 30. But now, with dealers and RTOs set to reopen shutters only on May 3, an extended deadline is warranted. As per records available with the court, there are 1,05,000 BS4 two-wheelers, 2,250 BS4 passenger vehicles and 2,000 BS4 commercial vehicles that have been sold but could not be registered.
