After Gujarat, Tamil Nadu to Reduce Traffic Violations Fine Under New Motor Vehicle Act

The new Motor Vehicle (Amendment) Act 2019 has come into force since September 1, 2019, and brings with it higher fines for several violations. Tamil Nadu, however, has decided to not implement the new fines as of now. This comes in as senior officials are mulling to bring down the fines and the Tamil Nadu CM Edapaddi will be giving a go-ahead for only 23 amendments and will slash the penalty amount as well.

Karnataka government reduces fines imposed under new Motor Vehicle Act

The slashed fine rates are as follows:

Overspeeding: Rs 1,000 (MCG) and Rs 2,000 (four-wheeler).
Dangerous driving: Rs 1,500-Rs 3,000
Not wearing safety belt: Rs 500
Caught without a helmet: Rs 500
For blocking an ambulance's way: Rs 1,000
Without insurance: Rs 1,000/2000 (LMV) and Rs 4,000 (HMV)
Without registration: Rs 2,000/3000 (LMV) and Rs 5,000 (HMV)
Using mobile phones while driving: Rs 1,500/3,000/5,000
Without license: Rs 1,000/2,000/5,000

Motor Vehicles Act: Mobile phones while driving to be allowed only for route navigation

The road transport and highways ministry on Saturday said that mobile phones can be used while driving a vehicle solely for route navigation, without disturbing the ‘concentration of the driver while driving.’ Talking on the phone while driving can attract ₹1,000- ₹5,000 fine.

The ministry said that it has amended rules under central motor vehicle rules, to facilitate maintenance of key vehicle documents such as a licence, registration documents, fitness certificates, permits, among others, through a web portal set up and maintained by the government. The electronic portal will also be used for recording offences including compounding, impounding, making endorsements, suspension and revocation of licenses and registrations, issuing e-challan, among others.

These rules will be implemented from 1 October, as a part of the Motor Vehicles (Amendment) Act that came into force a year ago to revamp the transportation rules and improve road safety through steps such as hefty penalties for traffic rule violations, upgradation of technology to curb corruption.

“Use of IT services and electronic monitoring will result in better enforcement of traffic rules in the country and will lead to removing harassment of drivers," an official statement said.

Authorities to monitor driver's behaviour

The details of revoked or disqualified driving licences will be recorded chronologically in the portal, which will help authorities monitor driver behaviour. According to the rules, police officer cannot ask for physical form of inspection of any vehicle-related document if it has been validated through electronic means. This would include cases where the driver is committed an offence that would demand seizure of any such documents.

Such seizures will have to be made electronically on the web portal and the details of the seized documents will be recorded chronologically. Such records will be reflected on a regular basis on the portal.

“Further upon demanding or inspecting any documents, the date and time stamp of inspection and identity of the police officer in uniform or any other officer authorized by the state government, shall be recorded on the portal. This would help in unnecessary re-checking or inspection of vehicles and further would remove harassment to the drivers," it said.

New Motor Vehicle Rules sets in from today. Key points you MUST know

New Motor Vehicle Rules: Many rules will change, including Motor vehicle rules from today, i.e. October 1, 2020 as some changes have been made to the Central Motor Vehicle Rules 1989, according to Union Ministry of Road Transport & Highways (MoRTH) notifications. The official release states that the use of IT services and electronic monitoring will result in better enforcement of Traffic Rules in the country and will lead to removing harassment of drivers and would facilitate the citizen.

"Ministry of Road Transport & Highways (MoRTH) has recently issued notifications regarding various amendments in Central Motor Vehicle Rules 1989 requiring the implementation of enforcement, Maintenance of Vehicular Documents and E-Challans through portal w.e.f 1.10.2020 for better monitoring and enforcement of MV Rules," MoRTH said in a statement. This step of the Ministry of Road Transport and Highways is likely to help out the citizens in availing transport-related services.

Let us know what is going to change in Motor vehicle rules from October 1:

• The central government has digitised documents including maintenance of vehicles, driving licences and e-challans that will now be done through an information technology portal from October 1, 2020.
• Drivers can drive a vehicle with only a valid soft copy of these documents attached to the vehicle.
• Drivers can maintain their vehicular documents on Central govt's online portal like Digi-locker or m-parivahan.
• Vehicular documents found validated through electronic means shall not be demanded in physical forms for inspection. Details of driving licences disqualified or revoked by the licensing authority will be recorded and updated chronologically in the portal.
• The details recorded in chronological order should be reflected on a regular basis on the portal has been provided for. Also, the record shall be maintained electronically and further the driver behaviour would be monitored.
• Provisions have been made for the procedure for Production and Obtaining Certificates in physical as well as electronic form, the validity, issuance of such documents and further the date and time stamping of inspection and identity of the Officer will be recorded.
• The ministry has extended the validity of fitness, permits, licenses, registration or other documents under Motor Vehicles Act, 1988 and Central Motor Vehicle Rules, 1989 till of December 31, 2020. The enforcement authorities have been advised to treat such documents valid till December 31
