Moderators, please reshelve the thread if its not in appropriate position ,and merge the thread if already one exists.

Can someone explain what are the norms in Indian law that govern with -Parts supply for discontinued models.

I mean-
You have 2003 wagon r on road as well as 2013 model wagon r also.
If 2003 wagon r's headlamp or any other different part(Different in looks from 2013 )is to be replaced, will the manufacture supply the same.
If not, then which Law prevails over this aspect?[confused]

Re: Parts Availability Norms of India

Customers facing service problems and spare parts shortages for their cars could soon be protected by law.

Automobile manufacturers may have to provide maintenance and spare parts for vehicles for five years after they withdraw the model or shut shop. A new car model is launched in India every month.
Daewoo Motors Ltd (which sold the Matiz and the Cielo), Premier Automobiles Ltd (Premier Padmini and 118NE), Hero Puch Ltd (mopeds) and scooter manufacturer LML have either closed shop or gone under.

The new law has been suggested in the 10-year automotive mission plan, which is being finalised by the government.

"We have received suggestions in this regard. There have been cases of automobile companies closing down operations. To address the problems faced by the hapless customer, some corrective measures are being initiated," an official from the ministry of heavy industries and public enterprises told Business Standard.

The Federation of Automobile Dealers' Associations has been receiving complaints from Matiz and Hero Puch owners on spares and service and has been referring them to different government agencies.

To govern the obligation among manufacturers, dealers and customers, the federation has been pushing for such a law.

"There is no balance in the Indian market. Automobile companies come out with models without any legal obligation on the shelf life of their product. This is leading to unnecessary litigation and disputes once these models are phased out. In the globalised Indian automobile market, a franchisee law will crystallise the roles of the manufacturer, dealer and customer and ensure smooth growth," said Binod Agarwal, president of the federation.

Automobile manufacturers will also have to improve their service and expand dealership networks to meet customer expectations.

If an automobile company closes or discontinues its service operations, the supply chain of dealers-vendors-retailers will ensure services to customers.

Taking a cue from similar laws in the US and the UK, manufacturers will ensure service and spare supplies for a stipulated period and abrupt closure of automobile companies could invite hefty fines and seizure of assets by the government.

Law to keep spares alive after model | Business Standard News

So looking from the above article, it seems 5-7 years would be the maximum shelf life to get spare parts of discontinued models

Re: Parts Availability Norms of India

I had put these queries only as-
1.2014 one kind of model is introduced
2.2015 it gets a facelift
3.2016 the entire concept is changed

How can customers get the spares in such commercialisation.
I am proud that Automobile companies are going with tastes of customers, but they must make sure that atleast for 5 years the spares should be available and must be manufactured.

Just to add a view of my friend whom i talked today-

Ford Ecosport ,Figo Aspire,Global fiesta -14- All have similar console, and layout.
Also diesel engines in 1 & 2 are same. This is a market strategy for spares also.

Similar strategy is evolved in Maruti Suzuki also,Swift ,Ciaz ,Dzire having same layout.

External components like Headlamp and equipments within bumper should also be looked into.

Re: Parts Availability Norms of India

Most spare parts are available from reputed manufacturers. A while back I was about to buy an old skoda octavia for my wife spare parts were still available despite the model being out of production for more than 5 years. If a manufacturer fully stops operation then the car will be void of quality spares examples include Peugeot,Daewoo etc. Even spare parts for very old models like Estate and Sierra are available from TATA.

Spare parts availability in open market

Hi, Does anyone know about a government rule or court order stating that spare parts must be made available in the open market other than dealership. If so, please give the order copy or link. I write this because a few of the dealers charge heavily for service due to nonavailability of spare parts outside.
Thank you

I am not sure about other manufacturers, but some like Maruti and TATA are excellent in this regard. Forget 2003, you can get most of the spares of models from early 1990s.

However there are manufacturers like VW who are unable to supply spares of latest and in-production cars like the VW Polo GT TSi. I had a 1st hand experience of the same. But I guess it is more because of the carelessness of the dealer, rather than the manufacturer.
